O R D E R

% 17.08.2016 Learned APP submits that present FIR was registered on the complaint of Mr. S.B. Pillai of Directorate of Revenue Intelligence (DRI). It is submitted that officials of DRI, Mumbai Zonal Unit as well as Delhi Zonal Unit had searched the residential premises of proprietor of M/s. Anmol Plast, situated at C-179, 3rd Floor, Vivek Vihar, Delhi as well as the factory premises at Dilshad Garden, Delhi by constituting two teams, comprising of officials of DRI. During the search of residential premises, two laptops and two mobile phones were seized and were brought to factory

premises. While office premises was being searched, petitioner along with co-accused came there and all of them gave beatings to the officials of DRI, inasmuch as snatched laptops and mobile phones. Learned APP submits that petitioner is not entitled to concession of bail in the above facts. Learned counsel for the petitioner submits that petitioner is the son of proprietor of M/s. Anmol Plast. He further submits that during search of the factory premises nothing was recovered and "nil panchnama" was prepared by the DRI officials. Petitioner did not beat anyone. A false case has been foisted on the petitioner.

Learned APP submits that petitioner had joined the investigations, which are complete and charge-sheet is likely to be filed. Keeping in mind the totality of circumstances, it is ordered that in case of arrest, petitioner be released on bail, subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of Investigation Officer/Arresting Officer/Station House Officer concerned. Bail application is disposed of in the above terms. Dasti.
