% 10.06.2016 Crl. M.A.9848/2016 (exemption) Allowed, subject to all just exceptions.

CRL.M.C. 2341/2016 The petitioner has filed the present petition under Section 482 Cr.P.C. seeking grant of interim bail till the disposal of the anticipatory bail application No.15241/2016 bearing FIR No.0792/2015 of Police Station Sagarpur, Delhi pending before the PO MACT, South West District, Delhi. It is contended that on 21.11.2015, the petitioner was granted interim protection by way of a pre-arrest notice of seven days. On 18.05.2016, an anticipatory bail application was filed by the petitioner. On the said application, the parties were referred to Mediation and on 19.05.2016, interim protection was granted. The mediation between the parties was not

successful, however, on 06.06.2016, when the matter was listed, the Investigating Officer could not appear and the case was adjourned to 13.06.2016 however no orders were passed continuing the interim protection granted till the next date.

In the above circumstances, the interim protection granted by the trial court on 19.05.2016 shall continue till the anticipatory bail application of the petitioner is taken up and disposed of by the concerned Court. It is clarified that this Court has not opined on the merits of the application and the concerned Court is free to dispose of the application pending before it without being influenced by anything stated in this order. The petition stands disposed of.

Dasti under signatures of the Court Master.
