% 19.02.2016 It is submitted by the appellant on instructions that all rights and contentions with respect to the claims arising out of the assets that are to be sold would be agitated in the counter claim pending before the Debts Recovery Tribunal. The counter claim has been preferred by the company in liquidation and the appellant. Learned counsel for the appellant, therefore, submits that the present appeal may be permitted to be withdrawn but in the above terms. Learned counsel for the respondents submits that the auction of

actionable goods is scheduled for 07.03.2016. Co.App.51/2014 is accordingly dismissed as withdrawn but in terms of the above observations. It is clarified that the order as regards payment of costs is not waived.
