% 19.09.2016 Munni Jha and Mukund Kumar Jha after passing of the last order have been visiting Delhi High Court Mediation and Conciliation Centre. They had also come to the chamber of one of us (Sanjiv Khanna, J.) on 14th September, 2016 at about 7.15 p.m. Arya and Varuni, the children had expressed their desire to remain and stay with Munni Jha. Mukund Kumar Jha was permitted and allowed to visit the house where Munni Jha is presently residing and interact with the children for about two
and a half hours. Mukund Kumar Jha, it is stated, had visited the house where Munni Jha is residing and even had lunch there. Ms. Pallavi S. Kansal, Advocate representing Delhi High Court Legal Services Committee states that she has interacted with the children. The children are now relaxed and have stated that they want to reside and stay with Munni Jha. The children, namely, Arya and Varuni, aged 8 years and 6 years, respectively, have reiterated and affirmed in the Court that they would like to reside and live with their mother Munni Jha. We have also spoken to Munni Jha, who is present in the Court. She states that in principle she has no objection if Mukund Kumar Jha visits the children but he should not shout or fight and disturb the peace and tranquillity in the house. We have perused the mediation report, which states that no settlement could be arrived at and mediation had ended in nonsettlement. Mukund Kumar Jha states that he will initiate appropriate proceedings including proceedings under the Guardianship Act. As already noted above, Munni Jha has stated that she would
have no objection in case Mukund Kumar Jha visits the children at her house, provided he does not shout or fight and disturb the peace and tranquillity in the house.
Ravi Nath Jha, father of Munni Jha is present in the Court and states that Mukund Kumar Jha can call him on his telephone before visiting the children. He also affirms that Mukud Kumar Jha had earlier visited the family and on the said occasion, no disturbance was caused.
Recording the aforesaid, the present writ petition is disposed of. We clarify that the arrangement and custody of the children, as stipulated and granted, is subject to modification and further order of the Guardianship Court/Family Court. Dasti under the signature of the Court Master to the parties.
