Learned counsel for the petitioner submits that the petitioner is a tenant, however, the petitioner is not getting electricity connection in the common area and hence the petitioner is not able to avail the facility of escalator, air conditioning, elevator, etc situated on the third floor of the suit property. He further submits that the petitioner has paid the electricity charges to the respondent.

On the other hand, learned counsel for the respondents No.1 & 2 submits that the petitioner has not deposited the electricity and maintenance charges for availing the facility in respect of elevator, escalator, air conditioning etc. installed in the suit property. 3.

Subject to the deposit of electricity and maintenance charges, if any, by the petitioner with the respondents, the respondents No.& 2 are directed to restore/provide the electricity to the petitioner for availing the services of elevator, air conditioning, escalator, etc. installed in the common area of the suit property.

In view of the aforesaid, nothing further remains to be considered in the present petition and the same stands disposed in the above terms. A copy of this order be given dasti to the parties, as prayed. (I.S.MEHTA) VACATION MEHTA JUNE 29, 2016 'dc'
