% 13.06.2016 By this second application filed under Section 438 of Cr. P.C., the petitioner seeks anticipatory bail in FIR No. 197/2016 under Section 307/302 of IPC, Police Station South Rohini, Delhi. Perusal of the record shows that the petitioner has preferred anticipatory bail application before this Court, which was dismissed as withdrawn on 11th May 2016.

Mr. Raghuvinder Verma, learned Additional Public Prosecutor for the State, on instructions from the Investigating Officer submits that the proceedings under Section 82/83 Cr. P.C. have been initiated against the accused.

Considering the facts and circumstances of the case and the fact that the earlier bail petition filed by the petitioner has been dismissed

as withdrawn and the proceedings under Section 82/83 of Cr. P.C. are pending against the accused, in the considered opinion of this Court, there is no question to entertain the second anticipatory bail application at this stage.

Accordingly, finding no ground, the present bail application is dismissed.
