% 13.11.2018 Mr. Rai has returned with instructions. He says that he has no objection, if this Court were to direct Delhi International Arbitration Centre (in short 'DIAC') to appoint an Arbitrator. Learned counsel for the petitioner is in agreement with the suggestion made by Mr. Rai.

Accordingly, the petition is disposed of with the directions to the DIAC to appoint an Arbitrator in the matter, not later than five days from the date of receipt of a copy of this order. The Registry will ensure that the Co-ordinator, DIAC is supplied a copy of this order. Needless to say that since the appointment is to be made by the DIAC, the proceedings will be governed by the Rules and Fee Schedule applicable to the proceedings conducted under the aegis of the DIAC.
