% 16.08.2016 W.P.(C) 5661/2016 & CM No.23454/2016 (stay) Although the respondent No. 2 is unserved, learned counsel for the petitioners state that as the Chairman of the Learned Debt Recovery Appellate Tribunal has been appointed and is hearing the matters, he wishes to withdraw the writ petition, as the application filed by the petitioner on 23.02.2016 for recall of the order dated 04.02.2016, and application for early hearing of the said application are listed before the DRAT on 22.08.2016. He also states the protection granted by this Court on 10.06.2016 be continued till the hearing, of the applications.
Noting the aforesaid submission, the writ petition is dismissed as withdrawn.
It is expected that the learned DRAT shall consider the applications filed by the petitioner and dispose of the same on the said date. The protection granted by this Court on 10.06.2016 shall continue till 22.08.2016.
