% 24.08.2016 IA No.10216/2016 This is a joint application filed under Order XXIII Rule 3 CPC, inter alia, praying that the suit be disposed of in terms of compromise agreement dated 05.08.2016. It is stated that the parties have entered into a compromise in terms of which the defendant has paid a sum of `1.75 crores by way of four cheques dated 04.08.2016. The learned counsel for the plaintiff states that in terms of the settlement the plaintiff seeks to withdraw the present suit.

Accordingly, the suit is dismissed as withdrawn. The plaintiff is at liberty to revive the suit in case any of the cheques are dishonoured.

The date already fixed before the Joint Registrar i.e. 14.09.2016 is cancelled.
