% 05.02.2019 CM APPL No. 5363/19 (U/O V Rule 20 CPC for substitution service of R-9) By this application appellant wants to serve the notice of this appeal upon R-9 by substitution mode.

It is stated in the application that petitioner tried her level best to find out the latest address of R-9 but did not succeed. It is also stated that the address of the respondent no. 9 given in the memo of parties is the last known address and the only address which is available with the petitioner. Hence, it is just proper to serve him the notice of this appeal through substituted service.

Having heard the learned counsel for the appellant and having perused the application, I am satisfied that the R-9 cannot be served by ordinary means. Therefore, the application is allowed. FAO(OS) 110/2018 1/2

On filing of PF, notice be issued to R-9 who be served by way of publication in the daily newspaper "Rajasthan Patrika" (Hindi) Rajasthan Edition. Dasti as prayed for.
