% 11.07.2016 By the present petition, the petitioner seeks setting aside of the order dated 6th May, 2016 passed by the learned Special Judge dismissing the application of the petitioner for modification of bail order dated 23rd December, 2014 wherein condition was imposed upon him not to leave the country without permission of the Court.
Learned counsel for the petitioner states that since the petitioner has availed the permission from the learned Trial Court three times and on each occasion he has shown his bonafide and come back as per the itinerary, the said condition for bail be modified.
Status report has been filed as per which after bail was granted to the petitioner on 23rd August, 2008, the petitioner left the Country without permission of the Court and did not attend the trial Court proceedings. He was declared proclaimed offender and due to this the trial has already been delayed.
Considering the conduct of the petitioner in earlier absconsion and having been declared proclaimed offender, I find no error in the impugned order dated 6th May, 2016 declining to modify the condition for bail that the petitioner shall not leave the country without permission of the Court. Petition is dismissed.
