% 06.08.2018 CM No.27918/2018 Delay of six days in filing the appeal is condoned. Application is disposed of.
LPA No.377/2018 & CM No.27919/2018 Learned Additional Solicitor General states that in this case, the respondent had given a number of undertakings, which were broken. It is stated that the premises in occupation of the respondent is located in the President's Estate and there are security and other concerns. The impugned order was not justified in allowing the respondent a period of six months to vacate the premises.
Respondent, who appears in person, states that he has made alternative arrangements and would be vacating the premises on or before 5.9.2018.
The learned ASG, on instructions from the official from the Office of the President Estate, states that in order to bring the litigation to an end, they would accept the said statement. In view of the aforesaid, the respondent is permitted to occupy the premises till 5.9.2018. The appellants would be entitled to take coercive steps, including recourse to police aid, if the premises is not vacated on or before 5.9.2018.
The respondent would also file an undertaking in this Court, within three days, stating that he would vacate the premises on or before 5.9.2018. In case of breach and non-compliance, it will be open to the appellants to file an application under the Contempt of Courts Act, 1971.
We also clarify that no application for extension of time would be entertained.
