The petitioner seeks regular bail in case FIR No.234/2016 under Sections 354/376 IPC registered at Police Station Jahangir Puri. Status report is on record.

I have heard the learned counsel for the parties including the complainant's counsel and have examined the file. The petitioner is in custody since 29.03.2016. Statement of the prosecutrix has been recorded.

Initially the FIR was registered under Section 354 IPC. There were no allegations of commission of rape. Subsequently, in her 164 Cr.P.C. statement, the prosecutrix alleged commission of rape. It further reveals that the prosecutrix and the petitioner were acquainted with each other since long and there was proposal for BAIL APPLN. 1290/2016

marriage which was declined by the prosecutrix. Physical relations took place between the two several times.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the Trial Court.
