% 07.10.2015 I.A.No. 21264/2015 filed by plaintiff under Rule 3 Chapter IV Volume 4 of Delhi High Court Rules for refund of excess court fees As per this application, plaintiff along with an application bearing I.A. No. 19159/2011 under Order 6 Rule 17 CPC filed the proposed amended plaint along with additional court fees of Rs. 30,000/-. Vide order of Hon'ble Court dated 26.07.2013 this application was dismissed with liberty to plaintiff to take fresh and independent action against the defendant. By way of present application, it is prayed that this said court fees of Rs. 30,000/- may be refunded along with requisite certificate under the above mentioned provision.

Considering the order dated 26.07.2013 as well as Rule 3 of Chapter IV of Delhi High Court Rules, the court fees filed by the plaintiff along with

application bearing IA No. 19159/2011 be refunded to plaintiff along with certificate that this application was rejected on technical ground and the value of the stamp should be refunded. IA stands disposed of. AR (O) to refund the court fees with certificate on 09.10.2015 at 3:00p.m to plaintiff/its counsel.

I.A.No. 21265/2015 filed by plaintiff seeking return of original documents Record shows that suit was rejected under Order 7 Rule 11 CPC vide order dated 21.01.2015 and the appeal was dismissed on 06.05.2015. Let all the original documents filed by plaintiff be returned to plaintiff'/its counsel subject to filing certified copies of the said documents. IA stands disposed of.
