O R D E R

% 12.05.2017 I.A.No.5738/2017 (under Order 32 Rule 7 CPC filed by plaintiff no.1) This is an application filed by the plaintiff no.1 who is the mother and the natural guardian of plaintiff no.2 who is her son aged 10 years. The prayer is for granting leave to the guardian to enter into a compromise/Memorandum of Understanding dated 26.4.2017 on behalf of plaintiff no.2; submission being that this compromise is in favour and for the best interest of plaintiff no.2. The terms of the compromise which are contained in the next application (I.A.No.5739/2017) have been perused. The prayer made in the application of the plaintiff no.1 appears prima facie to be correct. The prayer made in the application is allowed.

I.A.No.5739/2017 (u/O 23 Rule 3 CPC) This is a compromise application arrived at between the two plaintiffs and three defendants. This was an unfortunate case where the husband of plaintiff no.1 had died. Defendant no.3 is the brotherin-law and defendant nos.1 and 2 are the parents-in-law of the plaintiff no.1. The terms of the compromise are contained in the aforenoted application which has been duly signed by all the parties along with their supporting affidavit as also settlement agreement which had been arrived at before the Delhi High Court Mediation and Conciliation Centre dated 26.4.2017. The application along with the documents and the settlement agreement are collectively marked as Ex.P-1. Parties shall be bound by the terms and conditions contained in Ex.P-1. Suit of the plaintiff stands decree in terms of Ex.P-1. Decree sheet be drawn up accordingly.

Court fee be returned.

Suit disposed of.

Date of 06.7.2017 before Joint Registrar stands cancelled. I.A.No.17806/2014 Since the suit has been disposed, this application has become in fructuous. It is disposed of accordingly.
