The complainant is present in Court. She has handed over a cheque for the balance amount of ₹70,000/- bearing Cheque No. 390315 dated 16th December, 2016 drawn on State Bank of India, Shastri Nagar, Delhi to the petitioner and the keys of the flat to the petitioner, who is present in Court and is identified by the learned counsel.

The amount of ₹30,000/- has already been handed over to the learned counsel for the petitioner and thus it would be between the petitioner and the learned counsel for the petitioner to deal with the same. 3.
The petitioner states that he will neither have any objection to the grant of bail to the co-accused Surender Basoya, quashing of the FIR and disposal of the civil suit being Civil Suit No.216/2015 pending before Sh. CRL.M.C. 2359/2016
Rajesh Malik, Senior Civil Judge, Rohini Courts and the probate case pending before Dr. Shahabuddin, Additional District Judge Rohini Courts on the basis of settlement.

In view of the settlement arrived at between the parties, learned counsel for the petitioner on instructions from the petitioner who is present in Court seeks leave to withdraw the present petition seeking cancellation of bail granted to the respondent No.2.

Petition is dismissed as withdrawn, subject to encashment of the cheque of ₹70,000 paid to the petitioner today in Court. MUKTA GUPTA, J.
