% 22.08.2016 (1) The petitioner seeks anticipatory bail under Section 438 read with Section 482 Cr.P.C. in case FIR No.236/16 under Sections 377/323/506 IPC registered at Police Station Amar Colony. Status report is on record.
(2) By an order dated 24.06.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation. Status report reveals that the marriage between the petitioner and the complainant took place on 14.02.2014. A quarrel BAIL APPLN. 1308/2016
took place between the two on 5.4.2016.
It is alleged that the petitioner had unnatural sex with her.
(3) Status report further reveals that the petitioner had joined the investigation on 28.06.2016 and informed that he had already taken divorce from the victim on 3.1.2015. On complainant's persistence, they again started living together and the complainant even became pregnant. An unborn child died in her womb and she was admitted to Rockland Hospital. Talaqnama produced by the petitioner has since been verified.
(4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(5) The bail application and all pending application(s) stand disposed of.
