Learned senior counsel for petitioner fairly points out that disputed questions of fact may arise qua the settlement of accounts inter se the parties.

Learned counsel for respondent submits that as per the counter affidavit more than Rs.3 crores are due from the petitioner. This position has been countered by the petitioner who submits that as on date not more than Rs.7 lacs are due.

At this stage, learned senior counsel for petitioner submits that in view of the submission and counter submission he has instructions

to withdraw the present petition.

This petition is accordingly dismissed as withdrawn with liberty granted to the petitioner to approach the Civil Court and file a suit or take other appropriate legal remedy as permitted by law. Till the next fifteen days no coercive steps be taken. Petition disposed of.
