O R D E R

% 19.07.2016 Both the petitioner (accused) and respondent no.2 (complainant) are present in Court today.

During the course of hearing, petitioner and respondent no.2 have settled their disputes amicably. Petitioner has offered to pay `14 lacs to the respondent no.2 towards full and final payment of all his dues in respect of the cheque in question. This offer is accepted by the respondent no.2. Accordingly, it has been prayed that offence under Section 138 of the Negotiable Instruments Act, 1881 (for short, the Act) be compounded in view of the settlement arrived at between the parties. Since the parties have settled their disputes amicably, offence under

Section 138 of the Act is permitted to be compounded and the impugned judgment is set aside resulting in acquittal of the petitioner. Pursuant to the order dated 22nd June, 2016 petitioner has deposited `17 lacs in this Court. Out of the amount lying deposited in this Court, `14 lacs be released to the respondent no.2 and remaining amount together with interest, if any, be released to petitioner.

Petition is disposed of in the above terms.
