This O.A is disposed of with the observation and liberty to the plaintiff that plaintiff, in accordance with law, at an appropriate stage after leading of evidence by the parties can file an application under Order 11 Rule 12 and/or 14 CPC, in case plaintiff needs any documents available with

the defendant to prove the case of the plaintiff or dis-prove the case of the defendant.

O.A is disposed of accordingly.

CS(OS) 2079/2013 & CS(OS) No. 362/2011 2.

Both the suits will be fixed by the concerned District and Sessions Judge before one transferee court as issues in both the suits are related and the suits have to be therefore tried by one court. There is already an order dated 22.2.2013 of consolidation of two suits in Transfer Petition No.22/2012.

An Office Order dated 24.11.2015 has been issued by Hon'ble the Chief Justice in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, whereby ordinary suits which are not commercial matters having pecuniary jurisdiction up to the value of rupees two crores cannot be tried by this Court and commercial matters up to the value of rupees one crore cannot be tried by this Court. Accordingly, these suits are transferred for decision to the jurisdictional Court under the District & Sessions Judge (North West) Rohini Courts, Delhi.

Let parties appear before District & Sessions Judge (North West) Rohini Courts, Delhi on 7th April, 2016. Suit files be made available to the District & Sessions Judge (North West) Rohini Courts, Delhi, on the date fixed.
