% 27.06.2016 Crl.M.A.No.10077/2016 Allowed subject to all just exceptions.

The application stands disposed of.

BAIL APPLN. 1320/2016 Learned counsel for the petitioners has submitted that the petitioners are falsely implicated in the present case i.e. FIR No. 374/2016 with PS Patel Nagar, New Delhi under Sections 323/341/506/354/509/34 IPC. Learned counsel for the petitioners have further submitted that the petitioners are all relatives and family members and have been falsely implicated in the present case. He has further submitted that nothing is to be recovered from the possession of the petitioners and they are also ready to abide by the conditions, if imposed by this court and pray that the

petitioners be released on anticipatory bail. On the other hand, learned APP has vehemently opposed the bail application and submitted that allegations are of very serious in nature and they are not joining the investigation.

Keeping in view the facts and circumstances as nothing is to be recovered from the possession of the petitioners, the petitioners are directed to join the investigation as and when required. In the event of their arrest, the petitioners be released on anticipatory bail on their furnishing personal bond in the sum of Rs.15,000/- each with one surety of the like amount to the satisfaction of the concerned IO/SHO.

The present anticipatory bail application is disposed of with the above directions with condition that they shall not tamper with the prosecution evidence.
