CM(M) 623/2016 & CM 23716/2016 The challenge in this petition is primarily to the order dated 9th June, 2016 whereby the learned Trial Court had issued summons and notice on the suit as well as interim application for 16th July, 2016. Mr.G.S.Sistani, concedes to the fact that the present petition is necessitated because of the happenings on 17th June, 2016 as averred in para 33 of the petition. He states that he would withdraw the present petition, if this Court grants liberty to the petitioner to approach the trial court with a fresh application seeking appropriate orders.

Noting the aforesaid submission granting liberty, as prayed for to the petitioner, the present petition is dismissed as withdrawn. Dasti.
