CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 30.08.2016 By the present petition, the petitioner seeks anticipatory bail in FIR No.114/2016 under Section 385/384/420/419/468/470/471/120-B IPC registered at PS:Maurice Nagar, Delhi on the complaint of Professor Rajesh, former Head, DESCEE, Faculty of Social Science, University of Delhi. The allegations in the complaint were that one person introducing himself as Gautam informed him that a case has been filed against him for taking a loan of Rs.75,000/- from the Bank of India and in order to avoid arrest, pursuant to non-bailable warrants, he should transfer a sum of Rs.75,239/- in the account of Radhey Shyam Verma, who represented him to be the advocate. Panicked by the above, the complainant transferred the money. However, he informed the Police as well. During investigation, it was found one more case of similar nature was registered at PS:Crime Branch and other complaints were also received at PS:Maurya Enclave, Delhi. BAIL APPLN. 1327/2016

After the arrest of accused, disclosure statements were recorded and one of the persons involved in the chain of events was the present petitioner. As per the disclosure statement of Babbu Verma@ Radhey Shyam Verma, in whose account the money was transferred, the amount of Rs.75,239/- was handed over to the petitioner.

Considering the allegations levelled against the petitioner, I do not find it to be a fit case for grant of anticipatory bail. The bail application is dismissed.
