CM No. 23849/2016 & W.P.(C) No. 5783/2016 Learned counsel for the petitioner on instructions seeks liberty to withdraw the present writ petition and states that he shall raise all contentions and issues before the arbitrator. He states that he would press upon the arbitrator to decide the question of arbitrability as a preliminary issue.
Without expressing any opinion on merits, the writ petition is
dismissed as withdrawn giving liberty to the petitioner to raise all issues and contentions before the arbitrator, including the question of arbitrability to be decided as a preliminary issue.
