Mr. Mr. R.A. Worso Zimik, learned counsel accepts notice on behalf of the respondent.

Having heard learned counsel appearing on behalf of the parties, the Court is of the view that there are sufficient grounds for grant of leave to appeal. Accordingly, the criminal leave petition is allowed. The matter is directed to be registered as a criminal appeal and be listed in due course.

List the appeal in due course as per its own turn. The trial court record be requisitioned so as to be available before the next date of hearing.

The respondent will appear before the Registrar (Appellate) on 3rd February, 2016 and furnish a personal bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the Registrar (Appellate) for his

appearance in Court as and when the appeal is listed for hearing. The respondent will also furnish his active and operational mobile telephone number before the Registrar (Appellate).

It is made clear that the respondent will promptly inform this Court if there is any change in his residential address as well as his mobile telephone number.
