% 08.07.2016 File taken up today as 07.7.2016 was declared holiday. This petition relates to property no.65-E, Gautam Nagar, New Delhi. Orders passed by this Court in WP(C) No.5659/2016 of even date also relate to the same property. The petitioner in that case is Koushilya Bai. The present petitioner is her son. The order passed in that writ petition will also be read as the order to be passed in the present petition.

The prayers made in the present petition have been perused. They have challenged the order dated 10.6.2016 passed by the MCD

(Appellate) Tribunal vide which an order directing vacation of the status quo order earlier passed by the Tribunal has been made. The another communication dated 17.6.2016 is also the subject matter of the present petition by virtue of which the SDMC had given a show cause notice to the petitioner.

In view of the submission made by learned counsel for the SDMC that the order dated 10.6.2016 is the subject matter of the separate CM(M) petition which is listed before another Roster Bench for today and this fact having been admitted by leaned counsel for the petitioner. This petition has become infructuous. It no longer survives. It is disposed of accordingly.
