% 23.03.2017 The petitioner seeks regular bail in case FIR 790/2015 u/s 395/397/412/120B IPC registered at PS Bharat Nagar. The petitioner is in judicial custody since 17.02.2016.
Learned counsel for the petitioner submits that the eye witness and the complainant have both been examined. He submits that the mere recovery of Rs.1.09 lakhs from the petitioner would not suffice to implicate him in the offence. He submits that since the independent witnesses have already been examined and the examination of only the police witness is remaining, there is no chance of the petitioner influencing any of the remaining witnesses or tampering with the evidence.
Moreover, one of the co-accused, who is alleged to be part of the conspiracy, has already been released on bail. In view of the aforesaid, I am inclined to allow this application. The petitioner is directed to be released on bail, subject to: (i) his furnishing personal bond with one surety in the sum of Rs.35,000/- to the satisfaction of the Trial Court; (ii) he shall provide his mobile number at the time of his release to the Trial Court, which shall be kept in working condition at all times and shall not be changed without prior intimation to the Court; (iii) he shall not try to influence the witnesses or tamper with the evidence; (iv) he shall not leave the country without prior permission of the Court; and (v) he shall attend every date of hearing in the case.
