% 01.08.2016 Heard the counsel for the parties.
The appellant is aggrieved by an order by which limited visitation rights to her daughter Alina, aged 6 years, have been granted to the respondent/husband. The Family Court directed that the husband would be entitled to limited custody of the child (on designated Saturdays) twice a month between 3:00 P.M. and 5:00 P.M. on the succeeding Sundays.
After hearing counsels and considering the records, we are of the opinion that there is no infirmity in the order. At the same time, since the child Alina has not spent sufficient time with her father, the Court is of the opinion that after four such visitations, the Family Court should obtain a report of a child psychologist/counsellor who may appropriately interview and interact with Alina.
It was disclosed during the hearing that the respondent's parents are currently living in Delhi and that he stays with them. The affidavit of respondent's father namely Shri Vikas Chandra Srivastava to this effect has been furnished to the Court. It is directed to be taken on record.
Counsel for the respondent has stated that the appellant has not disclosed her correct address and has in fact stated four different addresses.
In the circumstances, the appellant was asked to mention the address from where the respondent can pick up his daughter, in compliance with the Family Court's order. The address according to the appellant is as under :- B-19, Sector 23, Major Gola Ram Colony, Dwarka, Delhi- 100 075 The appeal is disposed of, in terms of the above directions. The Registry shall mark a copy of this order to the concerned Family Court, for due compliance.
