O R D E R

% 01.12.2016 Ms. Rao has tendered a communication issued by the Jail Superintendent, Central Jail No.3, wherein it is stated that the jail conduct of the petitioner since the last date of hearing, i.e. 08.08.2016 has been found to be satisfactory.

The petitioner has preferred the present petition to seek a direction to the respondent to release him on parole for a period of one month. The petitioner stands convicted under Section 302/ 120B/ 34 IPC. He is undergoing life imprisonment. He has undergone 7 years and 27 days of incarceration as on 05.08.2016. The jail conduct has earlier been found to

be unsatisfactory. Consequently, the case was adjourned to await a further report with regard to his jail conduct. As noticed above, the same has now been found to be satisfactory.

In these circumstances, I am inclined to allow this petition. The petitioner is directed to be released on parole for a period of four weeks subject to:

i) his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; and v) he shall also not indulge in any criminal activity while on parole. Dasti.
