% 23.01.2017 1.

The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.326/2015 registered under Sections 498A/406/34 IPC at PS Nihal Vihar. Status report is on record. 2.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. By an order dated 15.07.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has joined the investigation since then. 3.

During the course of arguments, petitioner's counsel on instructions, agreed to pay `80,000/- to the complainant without prejudice and subject to future adjustment (if any). On this, the complainant has no objection to the grant of anticipatory bail. BAIL APPLN. 1378/2016

4.

Considering the facts and circumstances of the case and the petitioner's offer to pay `80,000/- to the complainant without prejudice and subject to future adjustment, he is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

He shall pay `80,000/- to complainant within four weeks through Investigating Officer by way of Demand Draft.

5.

In case of non-compliance, the complainant will be at liberty to approach this Court.

6.

The bail application stands disposed of.
