% 26.07.2016 By this petition filed under Section 482 of Cr. P.C., the petitioner is seeking quashing/setting aside the order dated 02.07.2016 for staying the summoning order dated 22.03.2016 passed by the learned Additional Sessions Judge - Mr. Deepak Garg, Patiala House Courts, New Delhi in Criminal Revision filed against the Complaint Case Nos. 981/1/16, 1005/1/16 to 1014/1/16, till the present application is heard.

During the course of hearing, it has been informed that the Transfer Petition (Crl) No.136/169 is pending before the learned

District & Sessions Judge, but the same could not be decided as the learned District & Sessions Judge has mentioned in his order that Criminal M.C. bearing Nos. 2440/2016 and 2444/2016 between the parties are pending before this Court.

Mr. Tushar Mehta, learned senior counsel for the petitioner, on instructions, submits that the purpose of filing the present petition will be served if the learned District & Sessions Judge is directed to dispose of the transfer petition pending before it. In view of the aforesaid contention raised by learned senior counsel for the petitioner, the present petition (Crl. M.C. No. 2440/2016) is disposed of with direction to the learned District & Sessions Judge to decide the transfer petition (Crl.) No.136/169 expeditiously.

So far as Crl. M.C. No. 2444/2016 is concerned, the same has already been dismissed as withdrawn, rendering the same being infructuous.

Consequently, both the petitions being Crl.

M.C.

No.

2440/2016 and 2444/2016 are disposed of.
