W.P.(CRL) 2112/2016 Issue notice. Mr. Lao accepts notice on behalf of the State. Respondent No.2 is present in Court and personally accepts notice. She is identified by the I.O. SI Sanjeev Kumar, Police Station - Shakarpur. She has also produced her driving license as proof of her identity, which has been seen and returned.
This petition has been filed by the petitioner to seek quashing of the FIR No.949/2014 under Section 498A/ 406/ 34 IPC registered at Police
Station - Shakarpur, Delhi against the petitioner on the complaint of respondent No.2. The petitioner No.1 and respondent No.2 were married according to Sikh rites on 12.04.2010. Disputes arose between the parties and, consequently, they have started living separately. On the complaint of the respondent No.2, the aforesaid FIR came to be registered against the petitioners. The petitioners have now arrived at a settlement with the respondent No.2 on 24.01.2015. Under the settlement, the petitioner No.1 and respondent No.2 have obtained divorce by mutual consent on 30.06.2016. Under the settlement, the petitioners agreed to make payment of Rs.14 Lakhs to respondent No.2 in full and final settlement of all her claims on all accounts. Respondent No.2, who is present in Court admits that she has received Rs.
10 Lakhs earlier from the petitioners under the settlement. The petitioners have tendered a further amount of Rs.4 Lakhs in Court today vide pay order No.632472 dated 22.07.2016, which has been accepted by respondent No.2. Respondent No.2 joins the prayer for quashing of the FIR in question. She states that she has arrived at the settlement of her own free will and without any force or coercion. Accordingly, no useful purpose would be served in proceeding further with the FIR in question and the proceedings arising therefrom. They are hereby quashed.
