This appeal under Section 54 of the Land Acquisition Act, 1894 impugns the judgment and decree [dated 12th August, 2010 in LAC No.73/2008 of the Court of Additional District Judge-05 (West)] on a Reference under Section 18 of the Act and seeks further enhancement in compensation.

The appeal came up first before this Court on 27th January, 2011, when it was admitted for hearing and ordered to be listed in due course. Vide last order dated 18th July, 2018, the applications for substitution of legal representative and condonation of delay in applying therefor were considered and allowed and the appeal again ordered to be listed in the category of 'Regulars' as per turn.

The appellants by CM No.38581/2018 state that in other appeals arising from other references with respect to other land acquired vide the same Notification and Award, being LA.APP. No.784/2005 titled Jamna Vs. UOI and other connected appeals decided on 8th July, 2011, the compensation for acquisition of land has been further enhanced. It is stated that this appeal be also allowed in terms of judgment in Jamna supra. 4.

The counsels for the respondents Union of India and Delhi Development Authority appearing on advance notice admit and on further enquiry state that Jamna supra has attained finality. 5.

Accordingly, the appeal is allowed in terms of Jamna supra and is disposed of.

Decree sheet be drawn up, subject to payment of additional court fees, if any.
