O R D E R

% 16.07.2018 The present petition has been filed by the petitioner, challenging the communication dated November 10, 2017, whereby the request of the petitioner for allotment of alternative plot in lieu of acquired land has been rejected on the ground that the petitioner has not furnished the requisite documents like Payment Certificate, Affidavit, SMC/RD, Death Certificate and Occupancy Status.

Learned counsel for the petitioner states that this Court may grant one opportunity to the petitioner to deposit the same. He relies upon an order

passed by this Court on May 22, 2018 in W.P.(C) 5186/2018, Bhanwar Singh v. Land & Building Department, wherein this Court has granted an opportunity to the petitioner to furnish the documents. Mr.Yeeshu Jain and Ms.Jyoti Tyagi, learned counsel appearing for the respondent justify the impugned communication dated November 10, 2017 in the facts of this case. They acknowledge the fact that this Court in similar circumstances, has granted opportunity to the applicants/petitioner(s) for submitting the documents and for reconsideration of their cases by the respondent.

Having noted the order of this Court and the Co-ordinate Bench of this Court, which have been referred to above, this Court is of the view that one more opportunity should be granted to the petitioner, to furnish the documents as referred to in the impugned communication dated November 10, 2017, within a period of six weeks from today. Accordingly, the communication dated November 10, 2017 is set aside. If any discrepancies are found in the documents submitted by the petitioner, the same shall be communicated to the petitioner within two weeks of consideration by the Recommendation Committee. The discrepancies if any shall be cured by the petitioner within a week thereafter. This is subject to the petitioner

depositing an amount of Rs. 15,000/- with the Delhi High Court Lawyers' Welfare Trust within four weeks from today. The proof of deposit shall be submitted to the respondent along with the documents. The respondent, through its Committee, on re-consideration, shall pass an order, which shall be communicated to the petitioner. If the petitioner is still aggrieved by the order to be passed by the respondent, liberty is with the petitioner to seek such remedy as available, in accordance with the law. The petition is disposed of.
