% 21.12.2018 CM APPL. 54533/2018 in MAC.APP. 495/2016 This is an application under Section 151 CPC filed on behalf of respondent Nos.2, 3 and 4 - claimants seeking release of the FDRs. Counsel for the claimants submit that the matter has already been disposed of by this Court vide judgment dated 04.08.2016. He further submits that the claimant - respondent No.1, who is the mother of respondent Nos.2 to 4 - claimants has expired and prays that the three FDRs issued in the name of respondent No.1 be transferred/released in favour of respondent Nos. 2 to 4 who are stated to be facing financial hardship. Keeping in view the submissions made by learned counsel for the claimants - respondent Nos. 2 to 4 and for the reasons mentioned in the application, the application is allowed with directions to the Manager, UCO Bank, Delhi High Court Branch to release/transfer the three FDRs which is

in the name of respondent No.1 - claimant (now deceased) into the savings bank account of the respondent Nos.2 to 4 - claimants, in equal share, along with the interest accrued thereon, if any, forthwith, after due verification, as per rules.

The Manager, UCO Bank, Delhi High Court Branch, be apprised of this order forthwith, to ensure its compliance. With aforesaid directions, the application is allowed and disposed of accordingly.

As prayed, copy of this order be given dasti under the signatures of Court Master.
