On the last date of hearing, the factum of the appellant's death was noted, and the State was directed to verify the same. 2.

Learned APP for the State has handed over a copy of the death verification report, which is taken on record. The report states that upon enquiry, it has been ascertained that the appellant/Mohd. Nazir @ Nanha expired on 05.05.2024, having been murdered within the jurisdiction of P.S. Jaffarabad, regarding which FIR No. 167/2024 was registered. Along with the report, a copy of the said FIR has been enclosed. The permission slip for burial in Qabristan No. 522 dated 15.05.2024, issued by the Jama Masjid, Madarsa & Qabristan Committee, has also been annexed. Further, statements of local witnesses and family members, along with the burial slip, are attached.

In view of the above, the present appeal abates and is disposed of as such.
