% 17.08.2016 By the present petition, the Petitioners seek quashing of FIR No. 229/2014 under Sections 323/330/342/34 IPC registered at PS Gandhi Nagar, Delhi on the complaint of Dinesh Kumar who was a minor when the complaint was lodged and is still a minor on the ground that the parties have settled the matter.
Dinesh Kumar along with guardian Ashok Kumar his elder brother, as his parents has passed away, is present in Court. Both of them are identified by the investigating officer. Both Ashok Kumar and Dinesh Kumar state that they have settled the matter with the petitioners and the injury caused to Dinesh Kumar were under confusion for which the CRL.M.C. 2453/2016
petitioners have already apologized to him and paid adequate compensation. They state that they do not wish to pursue the abovementioned FIR and the proceedings pursuant thereto.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No. 229/2014 under Sections 323/330/342/34 IPC registered at PS Gandhi Nagar, Delhi and proceedings pursuant thereto are hereby quashed.
The petitioners who are identified by the learned counsel and Ashok Kumar the elder brother and guardian of complainant Dinesh Kumar who is identified by the investigating officer have signed this order sheet in acknowledgment of their statements made before this Court. The petition is disposed of. Order dasti.
