% 10.12.2018 Vide order of 6th June, 2018 respondent had undertaken to deposit the rent of the residential accommodation in terms of the Rent Agreement of 29th December, 2017. Affidavit of compliance of 6th October, 2018 filed by respondent reveals that the rent of ₹42,000/- per month has been paid by the respondent till September, 2018.

It is pointed out by petitioner's counsel that in terms of Clause V of the Rent Agreement of 29th December, 2017, respondent is required to pay the maintenance charges etc. which comes to ₹10,000/- per month. Learned counsel for respondent undertakes that the maintenance charges etc. of ₹10,000/- per month would be paid to petitioner from the due date till September, 2018 within a period of six weeks. While taking on record the aforesaid undertaking, this petition is disposed of with liberty to petitioner to get this petition revived, in case respondent does not pay the maintenance charges etc. of ₹10,000/- per CONT.CAS(C) 509/2018
