% 28.07.2017 Crl. M. A. No. 12094/2017 (Permission for re-issue/renewal of the passport) By the present application, the appellant seeks permission for the reissue/renewal of the passport. The appellant was sentenced to undergo Rigorous Imprisonment for 3 years with fine and compensation of Rs.1 lac for the offence punishable under Section 304 Part-II. Vide order dated 07.12.2010, the sentence was suspended and the bail was granted to the appellant.

Perusal of order dated 07.12.2010 shows that no condition was imposed upon the appellant restricting him to travel abroad. It is, therefore, open to the passport authority to consider the application made by the appellant for reissue/renewal of a passport, in accordance with law.
