For the reasons set out in our judgment and order passed today in RFA(OS)No.38/2016, the present appeal filed by Ramesh Chander Sareen has to be dismissed. In fact, when the appeal had come for hearing, the counsel for the appellant in the present appeal had simply relied upon the arguments addressed by the appellant herein and the counsel for the appellants in RFA(OS)No.38/2016. Further, the appellant herein has not questioned and challenged the preliminary decree of partition and had only raised objections to the impleadment of Navneet Singh Anand. The appeal RFA (OS) No.65/2016
is accordingly dismissed in terms of our decision in RFA(OS)No.38/2016. There will be no order as to costs.
