W.P.(C) 5785/2016 The petitioner has filed the present petition seeking mandamus directing the respondent no. 2 to grant admission to the petitioner in B.A. (Pol. Science) Course as per the first cut-off list issued by the respondent on 30.06.2016. The contention of the petitioner is that the petitioner was qualified as per the first cut-off list to seek admission. The petitioner duly applied and submitted requisite documents. The

only document which was in issue was the original mark-sheet of Class 12th result. The respondent no. 2 insisted on a hardcopy of the copy downloaded from the DigiLocker directly from the CBSE data base and the same was duly submitted. It is further contended that the original was received late by the school which in District Buxar, Bihar and thus the original could not be produced in time. However, the photocopy was submitted by the petitioner along with the digitally signed mark-sheet. It is contended that one day's time was sought by the petitioner to submit the original, however, the same was not granted and the petitioner was denied admission. Learned counsel for the petitioner submits that the original mark sheet was tendered to the college on 04.07.2016 but was not accepted. Learned counsel for the petitioner, under instructions from guardian of the petitioner, submits that the petitioner has not taken admission in any other course in Delhi University.

Issue notice. Notice is accepted by the learned counsel for the respondent no. 1.

Dasti notice be issued to respondent no. 2, returnable on

13.07.2016.

In the meantime, in case the petitioner was eligible under the first cut-off list and there are seats available, one seat shall be kept reserved for the petitioner in B.A. (Pol. Science) Course. Renotify on 13.07.2016.

Copy of the order be given dasti under the signature of the Court Master.
