O.M.P. (E) (COMM.) 27/2018 This petition under Section 27 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking issuance of summons for appearance of the following witness:- "Mr.Alok Pandey, Chamber No. 12, B-Block, Civil Courts Complex, Mainpuri (U.P.)"
The Arbitrator in his order dated 31.05.2018 observed that the appearance of the said witness would be critical for appropriate adjudication of the disputes pending before the Arbitrator. The Arbitrator vide his order dated 21.08.2018 allowed the petitioner to seek assistance of this Court in the summoning of the said witness.
In view of the above, I do not find any necessity of issuing a formal notice of the petition to the respondent.
Let summons for appearance of the abovementioned witness be issued for his appearance before the Sole Arbitrator in Case Ref. No. DAC/157/0217 titled Shasya Mangalam Real Promoters(I) Pvt. Ltd. vs. Umesh Chand Verma & Ors. before the Delhi International Arbitration Centre on 28.09.2018 at 2:00 p.m.
The diet money shall be paid by the petitioner to the witness on his appearance before the Arbitral Tribunal.
The summons may be given dasti to the counsel for the petitioner for effecting service.
