O R D E R

The Commissioner in Claim No.CEC/SD/S/58/2010/325-330 has allowed the claim of respondent Nos.1 and 2 and had awarded the lump sum compensation in the sum of ` 8,84,100/- along with interest at the rate of 12% pa with effect from 20.03.2010 and penalty. 2.

The appeal filed by the appellant was admitted and the appellant had deposited ` 19,88,300/- with the Commissioner, Employees Compensation on 08.07.2016.

After negotiations both the parties have agreed that the aforesaid FAO 293/2016

amount of ` 19,88,300/- so deposited may go to the respondent No.1 and the respondents shall not claim any further sum from the appellant and would also not press for further penalty.

It is stated by the learned counsel for appellant that the amount is deposited before the learned Labour Commissioner was earlier deposited in the form of demand draft, but by the order of this Court, it was converted into a FDR. The amount so deposited in the form of FDR shall be released in favour of respondent Nos.1 & 2.

In the pre Lok Adalat sitting, respondent Nos.1 & 2 have also agreed to cooperate with the appellant for quashing of the FIR No.49/2010. 6.

The appeal and pending application stands disposed of in above terms.
