% 01.09.2016 The applicant has filed the present application before this Court under Section 27 of the Arbitration and Conciliation Act, 1996 for seeking assistance of this Court in summoning a witness - Mr Satish Kumar Rajput along with all documents and records of M/s Nova Electro-World. Dasti notice of this application was issued to the respondents. The learned counsel for the applicant has filed an affidavit of service which indicates that the respondent nos.1 & 2 have been served. It is further stated that respondent no.3 is a firm and stands dissolved. However, none appears on behalf of Respondent 1 and 2 today.

The learned counsel appearing for the applicant has drawn the attention of this Court to an order dated 08.03.2016 passed by the Arbitrator indicating the relevance of the witness and the documents to be produced by

the said witness. The said order also permits the applicant to approach this Court for summoning of the aforesaid witness. In the circumstances, the present application is allowed. The Registry of this Court is directed to issue summons to Mr Satish Kumar Rajput to appear before the Arbitrator on 19.09.2016 at 2:00 PM in Chamber No.49, Tehsil Building, Tis Hazari Court Complex. The witness shall also produce all relevant documents and records relating to the firm M/s Nova ElectroWorld on the said date. The application is disposed of.
