Ms. Akshita Katoch, appearing for the respondent, relies on the judgment of this Court in National Agricultural Co-operative Marketing Federation of India v. Nafed Processed Food Cooperative Marketing Federation of India Employees Union & Ors., 90 (2001) DLT 754 and the order dated 11th October, 2017, of the Division Bench of this Court in LPA No.657/2017 (Pradeep Goswami v. Union of India & Anr.) to contend that writ petition would not be maintainable against the respondent.

Mr. Yogesh Kumar, appearing for the petitioner, seeks a short adjournment to examine this aspect.

Renotify for hearing on the point of maintainability on 20th September, 2018."

Mr.Yogesh Kumar, appearing for the petitioner, is unable to distinguish the judgement of this Court in National Agricultural Cooperation Marketing Federation of India v. Nafed Processed Food Cooperative Marketing Federation of India Employees Union & Ors., 90 (2001) DLT 754. He, therefore, seeks leave to withdraw this writ petition so that he could avail appropriate remedies available to him in law. Reserving liberty to the petitioner to do so, this writ petition is dismissed as withdrawn.
