The counsel for the sole plaintiff and the counsel for the sole defendant in this suit for permanent injunction restraining infringement of trade mark and passing off and for ancillary reliefs state that the parties in FAO(OS) (COMM) No.214/2017, preferred by the plaintiff against the order dated 30th October, 2017 of denial of interim relief to the plaintiff, have on 17th January, 2018 arrived at a settlement before the Division Bench and the defendant has given an undertaking to the Court to not use the trade mark "SWAAD" and in terms of the said settlement, the present suit has also been decreed.

The counsels however state that they do not have the certified copy or any copy of the order till date.
