The order dated 25.4.2018 passed by a learned Single Judge of this Court in CS(OS) No.2429/2011 title as Vineet Jain Alias Vinit Jain & Anr. Vs. Saroj Kumari Jain & Others is on the record of this case. As per paras 9 to 12 of the order dated 25.4.2018, it becomes clear that the suit and the impugned judgment passed therein dated 9.3.2016 and this appeal, will not be determinative of the rights of the parties and the rights of the parties will be decided as per the decision in CS(OS) No.2429/2011. 2.

Counsels for the parties who appear before me today state that they agree with this position and therefore this appeal is disposed of by observing that rights of the parties will stand decided as per the judgment in

CS(OS) No.2429/2011 and the impugned judgment dated 9.3.2016 is agreed not to be determinative of the rights of the parties in the suit property bearing no.E-103, Ashok Vihar, Phase-1, Delhi. 3.

Appeal is accordingly disposed of.
