The issue of law raised in the writ petition was decided by this Bench yesterday in W.P.(C) 5867/2016 Kailash Chander Vs. Union of India & Ors. and W.P.(C) 5871/2016 Mohan Singh Vs. Union of India & Ors. 2.
Learned counsel for the petitioner who was the counsel in the said two writ petitions accordingly does not press the writ petition for the reason petitioner's posting is as a consequence of petitioner's promotion. However, request is made that BSF may retain the petitioner at Delhi for two months on account of petitioner's mother having undergone surgery in one eye and surgery in the other eye to be performed in the next month or so. W.P.(C) 5879/2016

While disposing of the writ petition as not pressed, we direct that upon petitioner submitting to DG, BSF necessary papers concerning his mother's continuing eye treatment, a decision would be taken sympathetically. Representation with documents shall be submitted by the petitioner in the office of DG, BSF, CGO Complex within two days. 4.
If submitted within two days, petitioner's movement order would be deferred for a period of two weeks.
