% 21.01.2019 Crl. M.A. no. 34228/2018 (for condonation of delay in re-filing) Delay in re-filing is condoned. Application is disposed of. CRL.M.C. No. 5258/2018 Respondent no. 2 Mr. Kailash Chand Pathak is present in Court along with his counsel and has been identified by Inspector Nafe Singh of police station Seelam Pur.

It is submitted that disputes arose between the petitioners and respondent no. 2 in respect of the sale transaction of an immovable property,

which led to registration of FIR no.

466/2015 under Sections 420/467/468/471 IPC at police station Seelam Pur. It is further submitted that petitioners and respondent no. 2 have settled their disputes amicably; therefore, aforesaid FIR and consequent proceedings emanating therefrom may be quashed. Respondent no. 2 says that he has already received the settled amount of `21,00,000/- from the petitioners and he has no objection in case aforesaid FIR is quashed against the petitioners. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
