% 19.09.2018 On 18.07.2018, this Court had passed the following order:- "
Issue notice.
Mr. Amit Gupta, the learned Additional Public Prosecutor accepts notice for the State.
The petitioner seeks bail in case bearing FIR No. 61/2018 registered at Police Station Burari under sections 376/328/506/377/34 IPG. His co-accused i.e. his brother and mother, enjoy the protection m terms of the order of the Supreme Court dated 09.05.2018 till the final disposal of their Bail Application No. 925/2018 (listed today at Serial No. 54). The counsel for the complainant in those cases has sought and been granted time to file a response. In the present case the petitioner has joined the investigations.
In view of the above, till the next date of hearing, the petitioner shall not be arrested.
Re-notify on 07.08.2018.
A copy of this order be given dasti to the learned counsel for the parties."
The petitioner has joined the investigations and undertakes to continue to do so when called.
In view of the above, it is directed that in the event of arrest of the petitioner in FIR No.61/18 under Sections 376/328/506/377/34 IPC registered at Police Station Burari, Delhi, he be released on bail on his furnishing a personal bond in the sum of Rs.10,000/- each with a surety in the like amount to the satisfaction of the Arresting/Investigating Officer, subject to the following conditions:
(i) the petitioner shall continue to participate in the investigations as and when they are so intimated by the Investigating Officer; (ii) he shall make no attempt, directly or indirectly, to contact the complainant or her relatives or close associates; (iii) he shall furnish his telephone number to the SHO/IO concerned, which the petitioner shall keep operational at all times, so that the police could contact him;
(iv) he shall not make any effort to evade the process of law; and (v) in case of change of the phone numbers or address, the petitioner shall inform the police forthwith.
The petition is disposed-off in the above terms. A copy of this order be given dasti to the learned counsel appearing on behalf of the parties.
